Which law applies here

Kognita is a Swiss website, operated from Switzerland for people in Switzerland. If you buy a report, the contract is governed by Swiss law. That is worth stating plainly, because readers who have moved here from the European Union, the United Kingdom, the United States or India often assume a legal position that does not apply in this country.

Three points before the formal details. First, Swiss law gives you no statutory right of withdrawal for an order placed on a website. The 14 days we grant are a voluntary commitment on our part, binding on us once written down, and the page Refunds and Withdrawal sets out why the difference matters. Second, the handling of your personal data is governed by the revised Swiss Federal Act on Data Protection (revDSG), in force since 1 September 2023, and not by the GDPR, although our privacy policy is written to answer the same questions a GDPR-trained reader will ask. Third, if you live in Switzerland and buy as a consumer, you can bring a claim against us at your own place of residence, and you cannot be made to give up that option in advance.

Value added tax

Kai Schnider is currently not liable for value added tax. No value added tax is charged on the prices shown and none is stated separately. The amounts named are the amounts you actually pay; nothing is added at the checkout.

This is not a courtesy, it is the rule. The Swiss Price Disclosure Ordinance (PBV Art. 4 para. 1 and Art. 13) requires the price shown to be the price actually payable, including every surcharge you cannot freely opt out of. All prices on this site are stated in Swiss francs, without a conversion into any other currency. There are no asterisk prices here and no fee that appears only in the final step.

How a contract comes about

The test itself is free. Only the detailed evaluation report as a PDF costs money. This is how the contract comes about:

1. You work through the test. Nothing is due for that.
2. You see a free short summary of your result and, next to it, the two report levels with their prices in Swiss francs.
3. You choose a level and enter your email address.
4. You see an overview of your order. As long as you have not triggered the payment, you can go back on this page and correct your entries, in particular the email address and the level you chose.
5. You pay through our payment service provider Stripe. The payment methods available are shown to you during the ordering process.
6. The contract comes about when the payment succeeds.
7. You immediately receive a confirmation by email together with access to your report.

The language of the contract is German. The English version of the terms is a translation for convenience; the German wording is the one that counts. You will find the contract text in the terms and conditions. We store your order so that we can send it to you again on request.

What Kognita is and what it is not

Kognita is a short online test. The result is a value for orientation, not a clinical expert opinion. It does not replace an assessment by a qualified professional, and it is not a basis for school placement, for filling a job or for decisions about medical or psychological care. What that means in detail is set out in the disclaimer. Please read it before you buy a report.

Copyright

The contents of this website, the test items and the reports are protected by copyright. You may use them for yourself personally. Passing them on, publishing them or exploiting them commercially requires our written consent. The rights you hold in your own report are described in the terms and conditions.

Technical operation

The website runs on servers operated by Hetzner Online GmbH at the Falkenstein site in Germany. Which data arises in the process is described in the privacy policy.

The location of those servers is a technical fact and nothing more. It does not by itself make the GDPR the law that governs this contract or the way we handle your data. The operator sits in Switzerland, the service is aimed at Switzerland, and the revDSG applies. If you are used to reading a hosting location as the signal for which data protection law applies, this is the point where Switzerland works differently: here the decisive question is who processes the data and for which market, not in which country the machine stands.
